Terms and Conditions for Institutions
These terms set out the conditions on which L&H Scientific Publishing LLC makes access to the L&H Scientific platform available to an institution. By signing a registration form or accepting these terms electronically, the subscriber confirms that it has read and agrees to these terms and that the person accepting them is authorized to do so on behalf of the institution.
Scope of License and Authorized Users
L&H permits the subscriber and its authorized users to access the service through the subscriber's registered IP addresses or, where IP access is unavailable or not unique, through user credentials. Credentials must not be disclosed or used to allow access by unauthorized persons.
For commercial institutions, authorized users include the institution, its employees, contract staff, and persons with authorized on-site access to the institution's information facilities. For educational institutions, authorized users include employees, faculty, students officially affiliated with the institution, library users with legal on-site access, contract staff, and persons affiliated with authorized remote sites or campuses in the same country.
Access is limited to the supplied site addresses and authorized access methods. The subscriber must maintain appropriate security measures and make reasonable efforts to ensure that only authorized users access the service and that they understand and comply with these restrictions.
Permitted Use
Authorized users may access, download, store, search, and print text. Copying must be limited to a single printed copy or electronic copies of a reasonable number of individual articles or similar items. Content may not be made available to non-authorized users, except as permitted for limited inter-library loan under applicable law.
Authorized users in commercial institutions may use the service only for internal research, testing, training, or personal use. Authorized users in educational institutions may use the service for private study or non-commercial research, and may include content in course packs if electronic copies are removed or deleted at the end of the relevant course term.
Prohibitions
Altering, recompiling, systematic or programmatic copying, reselling, redistributing, supplying, publishing, or republishing service content is prohibited. Downloading an entire issue, systematic downloading, service-bureau redistribution, for-fee printing, document delivery, and systematic transmission to non-authorized users are prohibited.
Duration and Continued Access
These terms become effective when accepted by L&H. The agreement continues for the agreed initial term and then on an annual rolling basis if the subscriber continues to comply with the terms and pay any applicable fee. Access may terminate immediately for uncured material breach after notice, or following at least 30 days' prior written notice by either party.
If L&H has expressly agreed in writing to provide continued access after termination, the subscriber may retain access to the agreed available content, subject to the terms of that agreement and any applicable maintenance fee.
Copyright, Fees, and Withdrawal
L&H journals and their content, including abstracts, are either owned by L&H or made available by L&H under rights it holds. Subscribers and authorized users claim no ownership through use of or access to the service.
Fees are those agreed in writing and are payable within 30 days of invoice unless otherwise agreed. L&H may withdraw a journal or part of the service if it no longer has the right to publish or distribute it, if publication ceases, or if L&H believes the content infringes rights or is unlawful, defamatory, obscene, or otherwise objectionable.
Availability, Warranty, and Liability
L&H uses reasonable endeavors to provide 24-hour access, subject to maintenance, repairs, testing, reconfiguration, upgrades, telecommunications downtime, Internet node failures, force majeure, and other circumstances outside L&H's reasonable control. L&H does not warrant uninterrupted or error-free access, completeness, accuracy, suitability, searchability, or fitness for a particular purpose. Liability is limited to the extent permitted by applicable law.
General
The agreement and access to the service may not be assigned or transferred by the subscriber. Failure to enforce a provision on one occasion does not affect a party's right to enforce it later. Amendments must be made in writing or by electronic communication initiated by L&H and not rejected within 30 days. These terms are governed by the laws of the United States.
